General Terms of Sale
Malherbes Castle — France
1. Purpose
These General Terms and Conditions of Sale govern all sales made by the company SAS Vignoble de Malherbes via its website.
Any order implies full acceptance of these terms and conditions.
2. Orders
Offers are valid within the limits of available stock.
Château de Malherbes reserves the right to refuse or cancel any order, particularly in the event of a prior dispute with the customer or suspicion of professional resale.
Quantities can be adjusted freely.
For security reasons during transport, we recommend orders in multiples of 6 bottles.
Any order is considered final after payment validation.
3. Prices
Prices are indicated in euros, all taxes included, and applicable in mainland France (excluding primeur wines).
They are subject to change at any time. Products are billed based on the price in effect at the time of the order.
4. Payment
Payment is made in full at the time of the order.
Payments are secured via payment service providers. Château de Malherbes does not have access to customers' banking data.
In case of payment refusal, the order cannot be validated.
The products remain the property of Château de Malherbes until full payment is received.
5. Delivery
Deliveries are made to the address provided at the time of the order.
Shipments are made from Monday to Friday, excluding public holidays.
The indicative delivery times are 8 to 10 working days in mainland France.
For any delivery outside France, a specific quote may be offered.
Château de Malherbes cannot be held responsible for delays attributable to the carrier.
6. Receipt of orders
Upon receipt, it is the customer's responsibility to check the condition of the products.
In case of damage observed, it is recommended to report it immediately and to contact us as soon as possible.
7. Substitution
Due to the nature of wine, certain vintages or references may be unavailable.
In this case, we may offer a product of equivalent quality and price, or proceed with a refund.
8. Right of withdrawal
The customer has a period of 14 days from the receipt of their order to exercise their right of withdrawal, under the conditions provided by law.
The terms are detailed in our Return and Refund Policy.
9. Personal data
Personal data is processed in accordance with our Privacy Policy.
The customer has the right to access, rectify, and delete their data.
10. Sale of alcohol
In accordance with current legislation, the sale of alcohol is prohibited to minors.
By validating their order, the customer confirms they are 18 years old.
11. Intellectual property
All elements of the site (texts, images, graphics, logos) are protected by copyright.
Any reproduction, even partial, is prohibited without prior authorization.
12. Liability
Château de Malherbes reminds that excessive alcohol consumption is dangerous to health.
Its liability cannot be engaged in case of improper use of the products.
13. Applicable law
These terms are governed by French law.
In case of a dispute, an amicable solution will be sought as a priority.
In the absence of an agreement, French courts will have jurisdiction.
